A federal judge in California ruled today that the state's same-sex marriage ban amounts to unconstitutional discrimination and should be immediately struck down. But U.S. District Court Judge Vaughn Walker issued a stay on the order as supporters of the measure seek an appeal.Absolutely abhorrent. The people voted and the measure passed.
Many speculate that the case will eventually reach the Supreme Court.
"Proposition 8 fails to advance any rational basis in singling out gay men and lesbians for denial of a marriage license," wrote Walker in a 136-page decision. "Indeed, the evidence shows Proposition 8 does nothing more than enshrine in the California Constitution the notion that opposite-sex couples are superior to same-sex couples."
At issue in the California case is a controversial ballot measure known as Proposition 8 that was launched in response to a state supreme court decision allowing gays and lesbians to wed. Prop 8 passed with 52 percent of the vote in November 2008.
